Supreme Court Throws Out Homeowners' Suit Against Indy Airport
WRTV-TV Ch 6 (ABC), Indianapolis (IN)
INDIANAPOLIS -- The Supreme Court has thrown out a lawsuit brought by some
Hendricks County homeowners over noise from Indianapolis International
Airport.
The state's high court rejected homeowner claims that the airport should
have to pay them because of noise from jets taking off and landing.
The suit contended the noise amounted to the government taking their
property without compensation.
Tuesday's ruling, written by Chief Justice Randall Shepard, said that
although the noise might be considerable, homeowners still make valuable use
of their land.
