Airport court case new twist

COVENTRY airport officials are to try to get injunction proceedings
against them kicked out of court this week.

Warwick District Council was due to start its arguments for an
injunction against Coventry Airport tomorrow, at the High Court in
London.

The injunction would mean the airport's temporary passenger terminal
could not be used.

But, the airport has now submitted a claim to the court for a 'strike
out' of the council's case - on the basis there is no case to be heard.

This will be heard at the court tomorrow and Friday and will be resisted
by the council.

Spokesman Richard Brooker said the council would proceed with
enforcement action, with the main case probably being heard in June.

He said: "We are proceeding with action against the unauthorised
development of a temporary passenger facility at the airport."

The date of the preliminary hearing would have been on Thursday and
Friday. But, after receiving the airport's evidence, the council was
advised there would not be time for a full hearing within the two days.

"We were advised the most effective course of action would be to set
aside the preliminary hearing and proceed to the main hearing so the
case can be put fully to the court."

Warwick District Council is arguing the passenger terminal breaches
permitted development rights as it is too large while airport bosses
deny this.
