Court Gives Control of Airport to Delta

DELTA - Delta has been awarded full control of Boundary Bay Airport by a 
decision of the B.C. Supreme Court. 

In June, the municipality filed a writ to gain control of the 28-year lease 
owned by Isy Rogowski, president of the Boundary Bay Airport Corporation. 
Rogowski had failed to pay $1.4 million in property taxes. Delta gave him 60 
days' notice but the bill remained unpaid and Rogowski was found in default of 
his lease. 

"The lease hung up the lands there for us," said Mayor Lois Jackson, who added 
Delta has been "baby-sitting" this issue for four years. 

Rogowski had many battles with a succession of councils since he acquired the 
lease 15 years ago. 

Those battles grew in 1997 when Transport Canada transferred ownership of the 
airport to Delta, but the lease remained in the hands of Rogowski, who had 
control over 194 hectares (485 acres) of land. 

Technically, Rogowski still has possession of the airport, Councillor Robert 
Campbell noted. Campbell, who sits on Delta's airport committee, said the 
municipality must serve him with the court order with Rogowski's lawyer 
present. 

"That may not happen until after Christmas or even in the new year," Campbell 
said. Jackson said YVR (Vancouver International Airport Authority) will 
temporarily take over the operation of the East Ladner airport until Delta 
issues a public call for proposals.
