Preliminary hearing held in South Shore runway lawsuit

PLYMOUTH, Mass. (AP) Preliminary hearings got underway Monday in a South
Shore lawsuit against a new runway at Logan International Airport.
The towns of Hull, Hingham and Cohasset have sued the Massachusetts Port
Authority, which operates Logan, claiming that an environmental review
of the new runway was faulty.
The three towns believe that the new runway, which the Federal Aviation
Administration conditionally approved in August, will increase air and
noise pollution.
Both sides sought a summary judgment Monday, asking that the case be
decided immediately without a trial. Judge Charles Hely took the
arguments under advisement.
The case is scheduled to go to trial Oct. 21.
Under the conditions of the FAA's approval, the new 5,000-foot runway,
which would be the airport's sixth, could only be used when winds out of
the northwest and southeast are blowing at 10 knots or greater.
Another lawsuit, regarding a 28-year-old injunction against constructing
a new runway, is scheduled to go to court early next year.
